MODERN DAY BATTLE  OF DAVID AND GOLIATH:ACADEMY OF COUNTRY MUSIC VS. ACM RECORDS  

ACM Records is fighting for it's name in a modern day
Battle of David and Goliath currently being played out
between the small independent record label based in New
Jersey and the Academy of Country Music, which allegedly
wants to use the title ACM Records to expand it's thriving
record business.
Despite the fact that the Academy of Country Music had
it's trademark application for the title "ACM Fan Jam"
rejected because of alleged copyright confusion
with ACM Records' existing trademark, the organization,
which is known for it's annual awards show televised on
CBS, has filed a lawsuit against ACM Records
in the Federal Count in Los Angeles, California seeking
to prevent the well respected indie music label from
continuing to do business under it's longtime corporate
name.
Founded 20 years ago by Al Cohen and Eve Adams, ACM
incorporated in 1991 and registered the company's
name in 2008. On February 21, 2011 the United States
Patent Office rejected an application by the Academy
of Country Music for use of the title, "ACM Fan Jam,"
ruling that the name could easily be confused with
the ACM Records trademark. Nonetheless, the Academy
of Country Music has continued to use the title,
"ACM Fan Jam," to promote live music events and in
2011 began to distribute compact discs under the name
"ACM ZinePak."
"We don't have a problem with the Academy of
Country Music using ACM as their abbreviation," said
the co-owners of ACM Records, "but we will not allow
them to infringe on our musical territory. If
necessary we may seek an injunction to prevent the
Academy of Country Music from distributing products
that confuse the public as to their source. The
Academy needs to practice what many of their artists
preach: America is all about fairness for the little
guy."
ACM Records represents hundreds of recording artists
from all types of musical genres including rock, folk,
country as well as hip hop artists such as MCBEE-X,
Shif-T, Warchild, Seven, Minister Kane, and the
legendary Grandmaster Melle Mel among many others. The
label also represents songwriters, composers, and
producers that have had tunes placed on major
television network stations ranging from NBC, CBS, E!,
MTV, Discovery to FX on programs such as "Smash",
"justified", "Law and Order", "Nikitia" and
"Saturday Night Live" just to name a few, in addition
to their artists songs placed in numerous feature
films including the smash country hit, "Brokeback
Mountain: and the hip hop classic, "Paid in Full"."

Creeptones

Many years ago, an idea for a band was conceived. The band would be as ambiguous as their name would suggest. 4 people confident that music would be made, polished, and performed when the time came. 2 years later, the band would emerge from a cavern they called Carmine\'s garage. It was where they were comfortable. Something grew inside them though, a deep rooted urge to get out and do something with the music they had been nurturing for so long. Creeptones would creep out of the garage, where they were going however, was yet to be determined. Would it be a backyard? A coffee shop? A college, festival, carnival, or a dive-bar? Quite possibly it would be all of these things. Maybe though, if you can dream, it would be somewhere a bit closer to home, a pair of a headphones, a memorable evening, your own heart. The soundtrack to the way you felt the first time you realized \'Wake up, wake up, this is really your life\' Creeptones are coming, and hopefully you will be too.

Winner of the 2011 ACM Record's Battle of the Bands competition. Rock music. Modern aesthetic with the spirit of music from the middle 20th century. There are 2 guitars, a bass, and a drummer. Some keyboards to add texture. All members sing with great use of harmonies. The Creeptones are from Toms River, NJ.

WHERE ARE ALL THE FANS???

The above question is what every local artist especially in hip hop should be asking themselves. Every local hip hop event I have attended in my adopted city of Charlotte NC has left me asking the same question: Where Are The Fans?  It seems that every time I attended any of these events, the people in the audience are either other hip hop artists such as emcees, rappers, producers or DJ's.  It's always an audience filled with people who are involved in hip hop in some way.  When I ask myself, WHERE ARE THE FANS?!, I'm talking about the average person who doesn't rhyme, make beats, DJ's, owns a label or etc. I'm talking about the average person that has a 9 to 5 job that just enjoys hip hop music in general.  I'm speaking about the person who has no desire to do anything hip hop related such as rhyming, making beats, DJing, etc. Whenever the FANS do attend, they usually come with the artist to be used as that particular artist's cheering section. When that artist has finished performing, the FANS usually walk out with the performer.  For example if artist so and so is scheduled to perform third, their fan/fans will stay in the venue until artist so and so performs and after that, leave.  So imagine if that artist is performing last, that artist will literally be performing for the people that came with him or her.  What I notice is very FEW "real fans" in my adopted city of Charlotte, NC go out to these local events and support local hip hop.

So, each time I go out to one of these local events, there are a ton of artists, DJ's and producers with CDs in hand and other promotional items, all ready to get on stage and shout out their myspace, facebook and youtube pages to an audience filled with their peers (other artists) who really don't give a f--k because they're about to get on next and do the same exact thing!  All of this makes it hard for artists to come up and sell their merchandise because in most cases local artists don't usually buy each others music. So as an artist at one of these local events, you are literally telling other artists  "yo, GO purchase my CD. It's on itunes." AND VICE VERSA. wow!

In my opinion, the solution is for these local artists to try to open up for more established acts that come to town, such as Gucci Mane, Young Jeezy, Jay-Z or etc. These artists will attract the average 9 to 5 job working hip hop loving fan to come out to the event. As result, the local artist now has a legitimate crowd to perform in front of and sell merchandise to, but as long these local artists are at these local venues performing only in front of their peers (other local artists), they will not be able to build a legitimate fan base.
